In Bangladesh, the Village Court operates under the Village Court Act, 2006 (Act No. 19 of 2006). Based on this Act, the Village Court Rules, 2016 were formulated to guide the structure, procedures, jurisdiction, and operations of village courts.
Composition:
The Village Court is composed of the Union Parishad Chairman and members nominated by both the complainant and the defendant.
Typically, the court consists of five members, including the Chairman.
Jurisdiction:
Village Courts deal with minor civil and criminal matters, such as:
Minor physical assault
Theft (within specified limits)
Compensation claims
Trespass, etc.
Procedure:
The complainant submits an application to the Union Parishad Chairman.
Upon acceptance, the Chairman issues summons to both parties and forms the court.
After hearing the case, the court delivers a verdict.
Appeal:
Appeals can be made under specific conditions:
Civil cases → Assistant Judge Court
Criminal cases → Magistrate Court
A recent amendment was made in 2024, titled the Village Court (Amendment) Act, 2024, which enhanced the jurisdiction and operational efficiency of village courts.
